आप पर भी लागू होती है चुनाव आचार संहिता, ये काम किया तो हो सकती है जेल!

लोकसभा चुनाव 2019 का नोटिफिकेशन जारी होते ही चुनाव आयोग की मॉडल कोड ऑफ कंडक्ट लागू हो गई है. इसके तहत आज देशभर में एक बड़ा अभियान चलाकर राजनीतिक दलों के होर्डिंग, बैनर, पोस्टर उतारे जा रहे हैं. साथ ही सरकारी योजनाओं के होर्डिंग उतारने का काम चल रहा है. आचार संहिता उल्लंघन की जानकारी चुनाव आयोग की हेल्पलाइन 1095 पर की जा सकती है. आयोग का दावा है कि 100 मिनट के भीतर एक्शन लिया जाएगा.

इसी के साथ आचार संहिता को लेकर लोगों में कई तरह के भ्रम के मामले भी सामने आ रहे हैं. जैसे कि कई सरकारी अधिकारियों के द्वारा आचार संहिता का हवाला देकर लोगों के कामों के मना करना भी प्रमुख है. एक आम धारणा के अनुसार ज्यादातर लोगों की मानसिकता ऐसी बन गई है कि आचार संहिता में सारे सरकारी काम बंद हो जाते हैं, लेकिन ऐसा है नहीं. आपकी जिंदगी से जुड़े जरूरी कामों पर किसी तरह की कोई पाबंदी नहीं है. इन अधिकारों को जानते रहें. लेकिन अहम बात यह कि क्या नहीं करना इसका ज्यादा खयाल रखें, अन्यथा आपको भी जेल की हवा खानी पड़ सकती है.

आचार संहिता लागू होने के बाद भी नहीं रुकेंगे ये 10 काम
1. पेंशन बनवाना

2. आधार कार्ड बनवाना

3. जाति प्रमाण पत्र बनवाना
4. बिजली-पानी संबंधित काम
5. साफ-सफाई संबंधी काम
6. इलाज के लिए आर्थिक सहयोग लेने जैसे काम
7. सड़कों की मरम्मत का काम
8. चालू प्रोजेक्ट पर भी कोई रोक नहीं लगेगी
9. आचार संहिता का बहाना बनाकर कोई अधिकारी आपके ये जरूरी काम नहीं टाल सकता
10. जिन लोगों ने मकान के नक्शे के लिए पहले ही आवेदन दे दिया है उनके नक्शे पास होंगे, लेकिन इसके लिए नए आवेदन नहीं लिए जाएं

आदर्श आचार संहिता के कारण इन पर रहेगी पाबंदी, आप पर भी लागू
1. सार्वजनिक उद्घाटन, शिलान्यास बंद.
2. नए कामों की स्वीकृति बंद होगी.
3. सरकार की उपलब्धियों वाले होर्डिंग्स नहीं लगेंगे.
4. संबंधित निर्वाचन क्षेत्र में नहीं होंगे शासकीय दौरे.
5. सरकारी वाहनों में नहीं लगेंगे सायरन.
6. सरकार की उपलब्धियों वाले लगे हुए होर्डिंग्स हटाए जाएंगे.
7. सरकारी भवनों में पीएम, सीएम, मंत्री, राजनीतिक व्यक्तियों के फोटो निषेध रहेंगे.
8. सरकार की उपलब्धियों वाले प्रिंट, इलेक्ट्रॉनिक और अन्य मीडिया में विज्ञापन नहीं दे सकेंगे.
9. किसी तरह के रिश्वत या प्रलोभन से बचें. ना दें, ना लें.
10. सोशल मीडिया पर पोस्ट करने पर खास खयाल रखें. आपकी एक पोस्ट आपको जेल भेजने के लिए काफी है. इसलिए किसी तरह मैसेज को शेयर करने या लिखने से पहले आचार संहिता के नियमों को ध्यान से पढ़ लें.

अगर कोई आम आदमी भी इन नियमों का उल्लंघन करता है, तो उस पर भी आचार संहिता के तहत सख्त कार्रवाई की जाएगी. इसका आशय यह है कि अगर आप अपने किसी नेता के प्रचार में लगे हैं तब भी आपको इन नियमों को लेकर जागरूक रहना होगा. अगर कोई राजनेता आपको इन नियमों के इतर काम करने के लिए कहता है तो आप उसे आचार संहिता के बारे में बताकर ऐसा करने से मना कर सकते हैं. क्योंकि ऐसा करते पाए जाने पर तत्काल कार्रवाई होगी. ज्यादातर मामलों आपको हिरासत में लिया जा सकता है.

उम्मीदवार और पा‌‌र्टियों के लिए नियम, उम्मीदवार को भी हो सकती है जेल
लोकसभा चुनाव 2019 के लिए चुनाव आचार संहिता लागू है. अब सरकार मतदाताओं को लुभाने वाली घोषणा नही कर सकती है. राज्यों में चुनाव की तारीखों के ऐलान के साथ ही सरकारी कर्मचारी चुनाव प्रक्रिया पूरी होने तक निर्वाचन आयोग के कर्मचारी बन जाते हैं. चुनाव आचार संहिता चुनाव आयोग के बनाए वो नियम हैं, जिनका पालन हर पार्टी और हर उम्मीदवार के लिए जरूरी है. इनका उल्लंघन करने पर सख्त सजा हो सकती है. चुनाव लडऩे पर रोक लग सकती है. स्नढ्ढक्र हो सकती है और उम्मीदवार को जेल भी जाना पड़ सकता है.

चुनाव के दौरान कोई भी मंत्री सरकारी दौरे को चुनाव के लिए इस्तेमाल नहीं कर सकता. सरकारी संसाधनों का किसी भी तरह चुनाव के लिए इस्तेमाल नहीं किया जा सकता. यहां तक कि कोई भी सत्ताधारी नेता सरकारी वाहनों और भवनों का चुनाव के लिए इस्तेमाल नहीं कर सकता. केंद्र सरकार हो या किसी भी प्रदेश की सरकार, न तो कोई घोषणा कर सकती है, न शिलान्यास, न लोकार्पण कर सकते हैं. सरकारी खर्च से ऐसा आयोजन भी नहीं किया जाता है, जिससे किसी भी दल विशेष को लाभ पहुंचता हो. इस पर नजर रखने के लिए चुनाव आयोग पर्यवेक्षक नियुक्त करता है.

कोई नेता नहीं कर सकता आपको परेशान
उम्मीदवार और पार्टी को जुलूस निकालने या रैली और बैठक करने के लिए चुनाव आयोग से अनुमति लेनी होती है. इसकी जानकारी निकटतम थाने में भी देनी होती है. सभा के स्थान व समय की पूर्व सूचना पुलिस अधिकारियों को देना होती है. कोई भी पार्टी या उम्मीदवार ऐसा काम नहीं कर सकती, जिससे जातियों और धार्मिक या भाषाई समुदायों के बीच मतभेद बढ़े और घृणा फैले. मत पाने के लिए रिश्वत देना, मतदाताओं को परेशान करना भारी पड़ सकता है. व्यक्ति टिप्पणियां करने पर भी चुनाव आयोग कार्रवाई कर सकता है.

किसी की अनुमति के बिना उसकी दीवार या भूमि का उपयोग नहीं किया जा सकता. मतदान के दिन मतदान केंद्र से सौ मीटर के दायरे में चुनाव प्रचार पर रोक और मतदान से एक दिन पहले किसी भी बैठक पर रोक लग जाती है. पूरी चुनावी प्रक्रिया के दौरान कोई सरकारी भर्ती नहीं की जाएगी. चुनाव के दौरान यह माना जाता है कि कैंडिडेट्स शराब वितरित करते हैं, इसलिए कैंडिडेट्स द्वारा वोटर्स को शराब का वितरण आचरण संहिता द्वारा मना है.

चुनाव अभियान के लिए सड़क शो, रैलियों या अन्य प्रक्रियाओं के कारण कोई यातायात बाधा नहीं होनी चाहिए. चुनाव के दौरान मतदान केंद्रों के आसपास चुनाव चिन्हों का कोई प्रदर्शन नहीं किया जाएगा. केवल चुनाव आयोग से वैध ‘गेट पास’ रखने वाले व्यक्ति को ही मतदान बूथ पर जाने की अनुमति होगी.

हेलीपैड, मीटिंग ग्राउंड, बंगले, सरकारी गेस्ट हाउस इत्यादि जैसी सार्वजनिक जगहों पर कुछ उम्मीदवारों द्वारा एकाधिकार नहीं किया जाना चाहिए. इन स्थानों को प्रतिस्पर्धी उम्मीदवारों के बीच समान रूप से उपयोग किया जाना चाहिए. प्रतिस्पर्धी उम्मीदवारों और उनके प्रचारकों को अपने प्रतिद्वंद्वियों के जीवन का सम्मान करना चाहिए. उनके घरों के सामने सड़क शो या प्रदर्शन आयोजित करके परेशान नहीं करना चाहिए. नियम उम्मीदवारों को इसे ध्यान रखने के लिए कहता है. मतदान पर्यवेक्षकों के पास मतदान में किसी भी मुद्दे के बारे में शिकायत दर्ज की जा सकती है.
