नान घोटाला : IAS टुटेजा के अभ्यावेदन के इन 11 बिंदुओं से कांपे नान घोटाले के मास्टर माइंड,डॉ रमन ने बदले की कार्यवाही बताया

रायपुर: नान घोटाल मामले में एस आई टी गठन के बाद आईएएस अनिल टुटेजा द्वारा राज्य सरकार को अभ्यादेवन नान घोटाले के मास्टरमाइंड समेत अन्य संदिग्धों में हडकंप मचा दिया है . मामले आरोपी बनाए गए टुटेजा ने शासन को 11 बिंदुओं के साथ लिखें पत्र में कहा कि इस मामले में ईओडब्लू ने जांच सही तरीके से नहीं किया है. शासन को लिखे पत्र में टूटेजा ने जिन 11 बिंदुओं को लेकर पत्र लिखकर निष्पक्ष तरीके से जांच की मांग की है. इस मामले में जहाँ पूर्व मुख्यमंत्री डॉ रमन सिंह ने राज्य सरकार को घेरते हुए इसे राजनितिक बदले की कार्यवाही निरुपित किया वहीँ टुटेजा के इस अभ्यावेदन के बाद राज्य सरकार ने इन 11 बिंदुओं को जांच के लिए ईओडब्लू को भेज दिया है. ईओडब्लू ने इस पत्र के आधार पर टूटेजा की ओर से दिए गए 11 बिंदुओं के साथ न्यायालय को आवेदन देकर कर यह मांग की है कि सरकार ने नान घोटाला मामले में एसआईटी का गठन कर दिया है. न्यायालय से मांग है कि एसआईटी की जांच परिणाम आने तक अग्रिम कार्यवाही स्थगित रखी जाए. इस मांग में ईओडब्लू की ओर से अब तक जांच में 11 ऐसे बिंदूओं के साथ आवेदन किया जो जांच में शामिल नहीं किए गए थे.

उल्लेखनीय कि सरकार ने नागरिक आपूर्ति निगम में हुए 36 हजार करोड़ के जांच के लिए आईजी स्तर के अधिकारी के नेतृत्व एसआईटी का गठन किया है. सरकार ने 3 महीने के भीतर एसआईटी को जांच पूरी कर रिपोर्ट देने को कहा.

आई ए एस टुटेजा के अभ्यावेदन के 11 बिंदू जिसे एसआईटी ने अपने जांच में शामिल किया है-

  1. प्रकरण में विवेचना जून 2014 से फरवरी, 2015 के बीच की अवधि मात्र की ही की गई है. उसके  पूर्व अवधि को अनुसंधान में शामिल नहीं किया गया है.
  2. शिवशंकर भट्ट से बरामद 113 पन्ने जिसमें अवैध लेनदेन का हिसाब होना बताया गया था. उनमें मात्र 6 पन्ने ही केस रिलेवेंट होने के कारण प्रकरण में संलग्न किए गए हैं. उन 6 पन्नों में वर्ष 2011 से 2013 के बीच की अवधि की जिलेवार करोड़ों की वसूली का वर्णन है. इन्हीं 6 पन्नों को चालन के साथ अभियोजन दस्तावेज के रूप में प्रस्तुत किया गया है. शेष 107 पन्ने कार्यालय में रखे हैं. इन 107 पन्नों में उक्त तथ्यों के संबंध में इस अपराध में विवेचना नहीं की गई है.
  3. केके बारीक के कंप्यूटर से बरामद 127 पन्नों में अवैध लेनेदेन का विवरण होना दर्शाया गया है. उपरोक्त 127 पन्ने कार्यालय में रखे गए हैं. अपराध में इन पन्नों की विवेचना नहीं की गई है.
  4. गिरीश शर्मा के घर में छापेमारी में 1.70 लाख रुपए नगद, अनेक वाहन, दो आवास, शॉपिंग माल तथा एक प्लाट होने की खबर प्रकाशित कराई गई. किंतु इस संबंध में असमानुपातिक संपत्ति अर्जित करने संबंधी विषय पर विवेचना नहीं की गई है.
  5. त्रिनाथ रेड्डी के निवास से जब्त नगदी रकम (42000) एवं संपत्ति के दस्तावेज जब्त किए गए हैं एवं जब्ती पत्रक अभियोग पत्र में लगाया गया है. किंतु इस प्रकरण में असमानुपातिक संपत्ति अर्जित करने संबंधी विषय पर विवेचना नहीं की गई है.
  6. केके बारिक के निवास के जब्त नगदी रकम (31800) एवं संपत्ति के दस्तावेज जब्त किया जाकर उस जब्ती पत्रक को अभियोग पत्र में लागया गया है, परंतु प्रकरण में असमानुपातिक संपत्ति अर्जित करने संबंधी विषय पर विवेचना नहीं की गई है.
  7. जीतराम यादव के घर से जब्त 36 लाख रुपए के संबंध में प्रमाणित हुआ कि उक्त राशि शिवशंकर भट्ट की है, अतएव इन्हें एसीबी के बैंक अकाउंट की जब्ती की गई है. एव जब्ती पत्रक अभियोग पत्र में संलग्न किया गया है. किन्तु प्रकरण में समानुपातिक संपत्ति अर्जित करने संबंधी विषय पर विवेचना नहीं की गई है.
  8. अरविंद ध्रुव से जब्त दस्तावेज को अभियोजन पत्र में लगाया गया है. प्रकरण में असमानिपातिक संपत्ति अर्जिक करने संबंधी विषय पर विवेचना नहीं की गई है.
  9. गिरीश शर्मा, अरविंद शर्मा, जीतराम यादव, केके बारीक तथा त्रिनाथ रेड्डी से बड़ी धनराशि तथा संपत्तियां बरामद होने के कारण उन्हें आरंभ में अभियुक्त बनाया गया था. माननीय उच्च न्यायालय ने गिरीश शर्मा, अरविंद ध्रुव एवं जीतराम यादव को धारा 319 दप्रसं के अनुसार वर्तमान स्थिति में मुल्जिम के रूप में समंस करने पर रोक लगाई है. विवेचना में इन्हें गवाहों के रूप में प्रस्तुत किया गया है.
  10. भ्रष्ट्राचार निवारण अधिनियम 1988 की धारा 20 अंतगर्त यह उल्लेखित है कि यदि किसी लोकसेवक से भ्रष्ट्राचार की राशि जब्त की जाती हो तो यह उपधारणा की जाएगी कि यह राशि उसने स्वयं के लिए ली है. उस राशि को अन्य किसी व्यक्ति के लिए लेना बताकर वह अपने दायित्व से मुक्त नहीं हो सकता.
  11. गिरीश शर्मा के जब्त कंप्यूटर के प्रिंट आउट, चार पन्ने में अनेक प्रभावशाली व्यक्तियों को रिश्वत की राशि प्राप्त होने का उल्लेख है किन्तु उसकी कोई विवेचना नहीं की गई. न ही गिरीश शर्मा के कंप्यूटर की हार्डडिस्क जब्त की गई.

इधर नान घोटाले को लेकर SIT जांच पर पूर्व मुख्यमंत्री रमन सिंह ने सवाल उठाये हैं। सदन में पूर्व मुख्यमंत्री ने जांच के फैसले को लेकर मुख्यमंत्री भूपेश बघेल को जमकर घेरा। रमन सिंह ने कांग्रेस की सरकार को बदलापुर की सरकार बताया है। मुख्यमंत्री ने फैसले के लिए सरकार को आड़े हाथों लेते हुए कहा कि आरोपी के कहने पर राज्य सरकार ने SIT जांच कराने का फैसला लिया और उसे कैबिनेट में पास कराया गया, ये बेहद ही हास्यास्पद है।
